How do I deal with the various collective bargaining agreements and changing legislation within the healthcare sector?

Collective bargaining law is important for employment law in healthcare. In healthcare, every institution is bound by a collective bargaining agreement. The most commonly used collective labor agreements are the CAO for Hospitals, the CAO for Nursing & Care Homes & Home Care (VVT), the CAO for University Medical Centers (UMC), the CAO for Disabled Care and the CAO for Mental Health Care (GGZ). These CAOs are still occasionally modified, which may require adjustments in personnel policies.

In addition to the relevant CAOs, legislation is also constantly changing. The most recent labor legislation is the Act implementing the EU Directive on transparent and predictable terms of employment. How do I fire a healthcare employee?

The regular dismissal law applies to healthcare employees. Employment can be terminated in the following ways:

  • Dismissal through the subdistrict court or the UWV;
  • Instant dismissal;
  • Settlement agreement (by mutual agreement).

No different dismissal rules apply to healthcare employees than to other employees. Yet the healthcare sector is distinguished by its own problems. Employees in healthcare facilities deal with vulnerable patients and residents, with occasional undesirable situations such as theft and other forms of abuse.
